2,206. Mi'un and Marrying a Kohein

The prohibition against a kohein marrying a divorcee applies to both a woman divorced from betrothal and one divorced from marriage. A girl released from marriage through mi’un (refusal), however, is permitted to marry a kohein, as was explained in Hilchos Geirushin 11:16. This is the case even if her previous husband divorced her with a get, remarried her, and then she released herself through mi’un. Any woman who is ineligible to perform chalitzah (to sever a levirate bond) but does so anyway is not disqualified from marrying a kohein.

If a rumor starts that a certain kohein wrote or gave his wife a get but she lives with him and serves him, she is not made to be divorced from him (on that assumption that he remarried his ex-wife, a divorcee). If her husband subsequently dies and she marries another kohein, she is made to be divorced.
