1,969. When the Fine Isn't Paid

We have already named the girls for whom a fine isn’t paid. There are ten: a girl who has reached maturity, one who dissolved a marriage through refusal (miun), one who was divorced, one with congenital infertility (who will not mature physically), one lacking mental competence, one with congenital deafness, a convert, a girl who had been taken captive, a freed servant and one who has a promiscuous reputation. The fine is paid for all other girls.

Whenever the fine is required, the offender must also pay for embarrassment, damages and – in the case of rape – pain. Whenever a fine is not required, she is not entitled to embarrassment and damages except for a girl who has reached maturity, one who dissolved a marriage through refusal, one lacking mental competence, and one with congenital deafness.
