1,970. If the Offender Confesses

Naarah Besulah 2:11

Pursuant to the previous halacha, if a man rapes a mature girl or one who had dissolved a marriage through refusal (miun), even though a fine isn’t paid, payment is still required for embarrassment, damages and pain. One who rapes a girl lacking mental competence or with congenital deafness must pay for her pain. A man who seduces one of these girls is not liable.

Naarah Besulah 2:12

A person is never liable to a fine based on his own confession. Rather, he is made liable based on the testimony of witnesses. Therefore, if a man says that he raped or seduced a certain girl, he is not liable to pay the fine, though he must pay for embarrassment and damages. Similarly, if a minor girl files a case against a man saying that he raped or seduced her, if he denies it, he must take an oath to uphold his claim because if he admits it, he would be liable for embarrassment, damages and pain based on his statement.
