1,968. "Regular" vs. "Irregular"

A seducer must pay for embarrassment and damages immediately; he is only required to pay the fine if he doesn’t marry the girl. This is based on Exodus 22:16, “If her father doesn’t want him to marry her, he must pay....” A rapist must make all four types of payment and marry the girl immediately. Accordingly, if she later wants to divorce him, or if she’s widowed, she isn’t paid anything (because she’s already received it).

Naarah Besulah 2:8

Let’s say that two men had relations with this girl, one in the regular fashion (i.e., vaginally) and the other “irregularly” (i.e., “sodomy”). If the man who had “irregular” relations was the first, he must pay for embarrassment and damages; if he was the second, he need only pay for embarrassment because she suffered damages from the first man. The one who engaged in “regular” relations must pay the fine plus all the other forms of payment regardless of whether he was the first or the second. Nevertheless, the embarrassment and damage to a girl who has never had relations at all are completely unlike the embarrassment and damage to a girl who has engaged in “irregular” relations.
