3,469. "This Produce is Leket, Shich’cha and Peah"
Hilchos Maaser 12:12
If needy people claim that produce is leket, shich’cha and peah (which are exempt from tithes), they are believed so long as there are granaries where leket, shich’cha and peah can be found and distributed near enough to go there and return on the same day. If they say that produce is from the tithes that are given to the needy, they are believed in the years of the shemittah cycle when those tithes are given. Their word is only taken when it comes to things that people would normally give as these gifts.

Pursuant to the previous halacha, if needy people say that wheat is from leket, shich’cha and peah, they are believed, but if they claim that flour is from leket, shich’cha and peah, they are not believed. It should go without saying that if they claim that bread came from the gifts given to the needy, they are not believed. Rather, it must be tithed as demai.
