3,277. The Daughter of a Kohein Who Marries a Non-Kohein
Terumos 6:6
A non-kohein who intentionally eats terumah is liable to the penalty of death imposed by Heaven, as per Leviticus 22:9: “They will die because of it, since they have defiled it.” This is equally true regardless of whether the person was ritually clean or unclean and whether the terumah was ritually clean or unclean. The one who ate the terumah is liable to lashes, but he need not repay for what he ate because a person is never liable to both lashes and financial penalties. If he ate terumah accidentally, then he must repay, adding a fifth, as per Leviticus 22:14: “One who eats the sanctified accidentally shall add a fifth to it.”
Terumos 6:7
The Torah tells us (Leviticus 22:12), “If the daughter of a kohein marries a non-kohein, she may not eat the sanctified terumah.” This teaches us two things: (1) a woman who engages in sexual intimacy with one of the prohibited relationships may never eat terumah; this is the same as is the case with any unfit person of kohanic descent (chalal), who is considered a non-kohein in all ways. (2) If this woman marries a Yisroel, she may never eat the portions of sacrifices given to kohanim – the breast and the thigh – even if she is later divorced or widowed.
