3,004. Consecrating Stolen Land

The previous halacha applies to movable goods. Let’s discuss real estate that was stolen and the thief denied doing so. If the rightful owner can have the land returned to him by the courts, then he can consecrate it even though he has not yet done so. This is because land is always considered to be in the domain of its rightful owners.

Hilchos Arachin Vacharamin 6:24

If a person X steals from person Y and person Y doesn’t give up hope of regaining the object, neither party can consecrate it. Person X can’t because the object doesn’t belong to him, and person Y can’t because the object’s not in his possession. The same rules apply in all comparable cases.
