1,770. When a Get is Either Written or Signed in an Agent's Presence

Let’s say that an agent says that a get was written in his presence but doesn’t say that it was signed in his presence, or vice versa, or if he says that the entire get was written in his presence but only one witness signed it in his presence – even if he was the other witness. In all of these cases, the signatures on the get must be validated. The get may only be delivered after this has been done. If the agent and another person both testify as to the second signature, which was not signed in his presence, then the get is valid and may be delivered. It goes without saying that if two other witnesses verify the second signature then the get is valid.

If two agents bring a get from outside Israel, they may deliver it and effect divorce even if the get wasn’t written and signed in their presence. Since the husband gave them the get to deliver, his objections are immaterial. The agents serve as witnesses even though the signatures on the get haven’t been validated. This is because if these witnesses said that the woman had been divorced in their presence, the divorce would be upheld even in the absence of the get.
