1,763. When the Sender May Have Died

If a city has been conquered and broken into, if a ship is lost at sea, or if a person has been taken out for execution by the secular authorities, or if he’s being dragged away by a predatory animal, swept away by a river, or an avalanche has fallen on him, then we must follow both the stringencies applying to living people and those applying to dead people. If such a person sent a get via an agent, the agent should not deliver it. If he did deliver it, the divorce is in doubt. If it’s known that the husband died before the get was delivered, the divorce is ineffective.

When a man sends his wife a get, he must provide her support and fulfill the other conditions of the kesubah until the get reaches her or a receiving agent assigned by her.
