1,684. Sexual Coercion

If a woman commits adultery accidentally (such as by having relations with the wrong man in the dark) or is coerced, she is permitted to remain married to her husband, as per Numbers 5:13, “and she was not raped,” from which we learn that if a woman was coerced, she remains permitted to her husband. This is true regardless of whether she was coerced by a Jew or a non-Jew. If a woman is sexually coerced at the beginning, she remains permitted to her husband even if she subsequently consented. This is true even if she says to let her attacker continue. In such a case, her urges have taken over but originally she was compelled against her will.

If women are abducted by brigands, they are considered to have been taken captive and sexually assaulted, so they remain permitted to their husbands. If they approached the brigands of their own volition, they are considered to have acted willfully and are rendered prohibited to their husbands. A woman who acts unintentionally is the same in halacha as one who was coerced.
