1,654. More About Yibum and Inheritance

Hilchos Ishus 22:12

If a man marries his late brother’s widow when produce is growing on land left by the deceased, the produce is sold and the money is used to buy land; the surviving brother enjoys the benefit of the profits that it generates.

Hilchos Ishus 22:13

If the deceased left harvested produce, money or movable property, it becomes the property of the surviving brother to use however he desires, even if the widow objects. Her right to collect the value of her kesubah from movable property comes from an enactment of the Gaonim, which does not override the surviving brother’s inheritance rights, inhibiting his use of this property.
