1,492. Is the Land Fit to Plant?
Hilchos Ishus 7:4
Let’s say that a man tells a woman, “You are consecrated to me through this object on the condition that I show you 200 zuz or enough land to plant a kor of grain.” Marriage is effected when he shows her these things. If he shows her someone else’s money or land, then marriage is not effected; he must show her things that belong to him. If he borrowed the money, rented a field or became a sharecropper on someone else’s land and showed her these things, marriage is not effected because he must show her things that belong to him. When he says, “I’ll show you,” the implication is that he’ll show her his own property.
Hilchos Ishus 7:5
Let’s say that the man does own enough land to plant a kor of grain but his field has crevices ten handbreadths deep (about 30”) or rocks ten handbreadths high. If the crevices are filled with water, they are considered like rocks and are not counted in the field’s total area because one can’t plant in them. If the crevices are not filled with water, they are counted in the field’s total area because one could plant in them.
