2,847. Affirming and Annulling the Same Vow

Let’s say that a betrothed maiden made a vow and only her father or her fiancée affirmed it, while the other person annulled it. Even if the one who affirmed the vow went to a scholar and had his affirmation overturned, he can no longer retract and annul the vow with the one who already did so because the vow can only be annulled by the two of them together.

Let’s say that a man tells his daughter or his wife regarding a vow, “It is affirmed for you; it is affirmed for you.” If he has the first affirmation absolved by a scholar, the second affirmation nevertheless takes effect. If he tells her, “It is affirmed for you; it is annulled for you, but the affirmation doesn’t take effect until after the nullification,” then the vow is annulled because the affirmation only takes effect after the nullification. However, if he says, “It is affirmed and annulled for you simultaneously,” then the vow is affirmed. If he says, “It is affirmed for you today,” it is affirmed in perpetuity. “It is annulled for you tomorrow” – it’s not annulled because he affirmed it for today so he can no longer nullify it for the next day. “It’s affirmed for you for one hour” – if the day passes without him annulling it, then he has affirmed it. This is not like saying that the vow is annulled after an hour because he never mentioned annulling it. “It is affirmed for you for one hour” – if, after an hour, he says, “It’s annulled for you,” then the matter is in doubt. In such a case, the subject of her vow is prohibited to her but she is not liable to lashes if she violates the vow.
