Kesubos - Daf 5

  • Must a chosson have relations Wednesday night for fear of his cooling off if done earlier?

The Gemara inquires: בתולה נשאת ברביעי ונבעלת ברביעי ולא חיישינן לאיקרורי דעתה – Did the Mishnah mean that a besulah marries on Wednesday and has relations on Wednesday, and we are not concerned about his cooling off if he doubts her being a besulah, or can she only have relations Wednesday night and we are concerned that otherwise he would cool off by Thursday morning? The Gemara says the answer can be learned from what Bar Kappara taught: A besulah marries on Wednesday and has relations Wednesday night הואיל ונאמרה בו ברכה לדגים – since a berachah for fish was said on that day. An almanah is married on Thursday and has relations Thursday night הואיל ונאמרה בו ברכה לאדם – since a berachah to Adam  was said on that day. We see from here that the reason for having relations Wednesday night is only because of the berachah and not out of concern for his cooling off. When the Gemara asks why the almanah does not have relations on Wednesday as well, for the berachah of fish, it answers, ברכה דאדם עדיפא ליה – the berachah for man is preferable to him. Alternatively, שקדו חכמים על תקנת בנות ישראל -the Chochomim were concerned for Bnos Yisroel, and made him have relations Thursday night, שיהא שמח עמה שלשה ימים – that he should rejoice with her for three days, Thursday, Friday and Shabbos.

  •  Using one’s fingers or earlobes to block out things one should not listen to

Bar Kappara darshened: Why is it written in the passuk, "ויתד תהיה לך על אזנך" – You shall have a spike in addition to your weapons (azeinecha)? Do not read it as "אזנך" – your weapons, but rather אוזנך – your ears,יניח אצבעו באזניו שאם ישמע אדם דבר שאינו הגון – that if a person hears something that is not proper, he should place his finger, which Rashi explains is tapered like a spike, in his ears. It was taught in the Beis Midrash of Rebbe Yishmael, מפני מה אוזן כולה קשה והאליה רכה – Why is the entire ear hard, while the lobe of the ear is soft? שאם ישמע אדם דבר שאינו הגון יכוף אליה לתוכה – that if a person hears something that is not proper, he will be able to bend the lobe into his ear, blocking the sound. It was taught in a Baraisa: אל ישמע אדם לאזניו דברים בטלים מפני שהן נכוות תחלה לאיברים – A person should not allow his ears to hear idle talk because the ears are the first to burn of the limbs. Since they are soft and thin, they burn first.

  •  מהו לבעול בתחלה בשבת – דם מיפקד פקיד או חבורי מיחבר

The Gemara asks regarding having relations with a besulah: מהו לבעול בתחלה בשבת – What is the halachah regarding having relations for the first time on Shabbos? דם מיפקד פקיד – Is the blood stored in her body, which Rashi explains means that it is simply released when the hymen is broken, and not absorbed in the body, in which case it is not wounding that is causing it to bleed,   או חבורי מיחבר - or is the bleeding a result of a wound, which Rashi explains occurs when the vaginal walls tear and bleed as they are separated from one another? The Gemara clarifies the question. If the blood is merely stored, is it primarily the blood that he needs to establish her as a besulah and that is permitted, or is it the pesach, the passageway that he needs, which is prohibited under the melachah of boneh. And if you say it is for blood, and the opening just comes about, do we rule like Rebbe Shimon that דבר שאין מתכוין מותר – that something unintended is mutar, or like Rebbe Yehudah who says it is assur? And if it is like Rebbe Yehudah, is it מקלקל – an act of destruction that is creating the opening, which Rebbe Yehudah holds is mutar, or is it מתקן – a constructive act, which is assur. The Gemara brings a second version of these series of questions.
