  • חבית של זהב שאינה מקודשת

The Mishnah on Daf 48b stated regarding ניסוך המים, כמעשהו בחול כך מעשהו בשבת – Just as it was performed on a weekday so is it performed on Shabbos, except that the Kohen would not draw the water from the מי שילוח on Shabbos itself; rather, on erev Shabbos he would fill a חבית של זהב שאינה מקודשת - an unconsecrated golden barrel, from the Shiloach, and have it in the chamber to be used the next day. The Gemara on 49b asks why an unconsecrated barrel was necessary, and Ze’iri answered קסבר אין שיעור למים – the Tanna of our Mishnah maintains that no maximum amount is prescribed for the water libation וכלי שרת מקדשין שלא מדעת – and furthermore, he maintains that klei shareiss sanctify their contents without intention. If one brought the water in a kli shareiss on erev Shabbos, it would become passul through לינה – by remaining overnight. Chizkiyah said that klei shareiss do not sanctify except with specific intent, so there is no concern of actual לינה, however they were gozeir that it should be placed in an unconsecrated vessel lest onlookers see the water in a kli shareiss and assume it was sanctified with intent. Rebbe Yannai in the name of Rebbe Zeira provides a third answer.

  • החליל אינו דוחה לא את השבת ואת לא את יום טוב

The opening Mishnah of the fifth perek states that the חליל, the flute-playing that accompanied the שמחת בית השואבה, was not docheh Shabbos or Yom Tov. It was taught in a Baraisa: החליל דוחה את השבת דברי רבי יוסי בר יהודה – Rebbe Yose bar Yehudah holds that the flute-playing is docheh Shabbos, and the Chochomim say: אף יום טוב אינו דוחה – it is not even docheh Yom Tov. Rav Yosef said that the machlokes was stated only in reference to the שיר של קרבן – the flute playing that accompanied the wine libations of the morning and afternoon tamid on the twelve days that Hallel was recited. Rebbe Yose holds עיקר שירה בכלי – the essential shirah is with instruments, ועבודה היא – and therefore, it is deemed an avodah and is docheh Shabbos. Whereas the Rabbanon hold עיקר שירה בפה – the essential shirah is vocal, and the instrumental accompaniment is not an avodah and so is not docheh Shabbos. אבל שיר של שואבה דברי הכל שמחה היא ואינה דוחה את השבת – but the playing of instruments that accompanied the שמחת בית השואבה, everybody agrees that it is merely to enhance the rejoicing, and is not a true avodah, and therefore, is not docheh Shabbos.

  • מחלוקת בכלי שרת שעשאן של עץ

It was taught in a Baraisa כלי שרת שעשאן של עץ רבי פוסל ורבי יוסי בר יהודה מכשיר – Regarding the suitability of klei shareis that were fashioned from wood, Rebbe is possel them and Rebbe Yose bar Yehudah is machshir them. After Rav Yosef’s understanding of the machlokes is rejected, the Gemara suggests that perhaps all agree דעיקר שירה בכלי – that the essential shirah is with instruments, and that the אבובא דמשה – Moshe’s flute, which was made from wood, was in fact, a kli shareis. And what they are disputing here is whether דנין אפשר משאי אפשר –we can derive a possibility from an impossibility. Do we derive the suitability of wood for other service vessels, where metal would serve as well, from the case of Moshe’s flute, where metal would not have served as well, since a metal flute would not have sounded so sweet? Or perhaps, since the flute had to be made of reed, no proof can be brought for the other service vessels. Rebbe Yose bar Yehudah, who is machshir wooden vessels, holds דנין אפשר משאי אפשר, whereas Rebbe, who is possel them, holds לא דנין אפשר משאי אפשר. The Gemara brings an alternative pshat in the machlokes.
