2,069. Forms of Blood in the Same Category

Hilchos Issurei Biah 5:25

If a man is intimate with a virgin and she doesn’t bleed, then he is intimate with her again and she does bleed, the presumption is that this is menstrual blood; this is the case even if the girl is a minor. The reason for this is that if it were hymeneal blood, it would have happened during the first act of intimacy. If a man is intimate with a girl under the age of three* and she bleeds, it is hymeneal blood.

*Editor’s note: this is not to suggest that such a thing is permitted, it merely discusses the halachic ramifications of the scenario should it occur.

Hilchos Issurei Biah 6:1

The bloods of niddah, of zivah, from before giving birth and the pure blood that follows giving birth are all in a single category of blood because they all originate in the uterus. The laws applying to this blood, however, vary based on the scenario, causing the woman who finds such blood to be ritually clean, a niddah or a zavah, depending on the circumstances.
