  • שימוש נותר לאו מילתא היא

The next Mishnah states, העצמות והגידין והנותר ישרפו בששה עשר – The bones, sinews, and leftover flesh of the pesach, must be burned on the sixteenth of Nissan. Rav Mari bar Avuha said in the name of Rebbe Yitzchak, עצמות קדשים ששימשו נותר – Bones of any kodshim that served as a carrier of nossar, מטמאין את הידים הואיל ונעשה בסיס לדבר אסור – are metamei the hands mid’Rabbanon, like nossar itself, since they served as a bosis for a forbidden object. The Gemara seeks to support Rebbe Yitzchak’s statement from the Mishnah which stated that the bones must be burned. If the bones had no marrow, why must they be burned? Let people discard them! Rather it must be that since the bones had marrow in them, which subsequently became nossar, the bones become a bosis to that nossar, and therefore must be burned. The Gemara rejects this proof saying, שימוש נותר לאו מילתא היא – serving nossar as a bosis, is not a factor, and the Tanna of our Mishnah holds that when the Torah stated, ועצם לא תשברו בו – you shall not break a bone in it, בו – the term “in it” means בכשר ואפילו בפסול – a kasher pesach and even a passul pesach. Since it is forbidden to break open the bones even after the pesach becomes nossar, they must always be burned because of the marrow in them. However, the bones themselves do not inherently require burning.

  • כל הגידין בשר חוץ מגידי צואר

Rav Yehudah said in the name of Rav, כל הגידין בשר חוץ מגידי צואר – All sinews are considered flesh except for the sinews of the neck. Rashi explains that the sinews are considered meat and therefore, when people register for the pesach and there must be a kezayis of “flesh” for each registrant to eat, the sinews may be counted as flesh. The neck sinew is very hard and is considered like wood, rather than flesh. The Gemara attempts to challenge Rav’s ruling from our Mishnah and brings a number of resolutions.

  • Burning on the 17th when the 16th falls on Shabbos

The Mishnah stated, חל ששה עשר להיות בשבת ישרפו בשבעה עשר לפי שאינן דוחין לא את השבת ולא את יום טוב – If the sixteenth of Nissan fell on Shabbos then the bones, sinews and nossar are burned on the seventeenth because the mitzvos to burn them are not docheh Shabbos or Yom Tov. The Gemara asks why the burning does not override Yom Tov. ניתי עשה וידחי לא תעשה – Let the aseh to burn nossar come and be docheh the lo sa’aseh of not doing melachah on Yom Tov? Chizkiyah said, and so it was taught in a Baraisa in Chizkiyah’s yeshiva, the passuk states, לא תותירו ממנו עד בקר והנותר ממנו עד בקר באש תשרפו – You shall not leave any of it until morning; and any of it that is left until morning you shall burn in the fire. Why was it necessary to state עד בקר a second time? ליתן לו בקר שני לשריפתו – To give the pesach a second morning for its burning, which refers to the first morning of Chol HaMoed. Abaye and Rava bring two additional sources. Rav Ashi said "שבתון" דיום טוב עשה הוא - the passuk regarding rest on Yom Tov is an aseh, ואין עשה דוחה לא תעשה ועשה – and a single aseh, such as the mitzvah of burning nossar, does not override the combination of an aseh and lo sa’aseh.
