2,045. Liability with a Shifcha Charufa
Hilchos Issurei Biah 3:16
In every case involving a shifcha charufa where there is no liability, the man isn’t liable for an offering and the woman isn’t liable for lashes. The man, however, is given stripes for acting rebelliously by rabbinic edict if both parties were adults who participated intentionally.
Hilchos Issurei Biah 3:17
If a boy nine years of age is intimate with a shifcha charufa, she is lashed and he must bring an offering. This is assuming that she’s an adult non-virgin who participated willfully, as has been discussed. This is because a man isn’t liable to bring an offering until this woman is liable for lashes, as per Leviticus 19:20-21, “There will be an inquiry.... he will bring his guilt offering.”
