1,996. A Woman Suspected of Impropriety

The previous halacha applies only when the residents of the city gossiped about this couple for 36 hours or more, saying that this man committed adultery with this woman and the rumor didn’t abate. Furthermore, it only applies when neither of the people involved have enemies who spread the rumor. However, if the rumor had not spread throughout the city, or if it abated for a reason other than fear, then if this couple marries, they need not be separated even if they haven’t had children. Even if one witness arrives and testifies that this woman committed adultery with this man, they are not made to divorce.

Let’s say that a woman who was divorced for inappropriate behavior marries someone else. If her second husband divorces her, she may not marry the man who caused her first husband to divorce her. If she marries him, however, they are not made to divorce even if they haven’t had children.
