1,971. A Partial Concession

Naarah Besulah 2:13

If a girl claims to have been raped but the accused claims that he seduced her, he is required to take an oath regarding the payment for pain, and to pay for damages and embarrassment. The oath is necessary because he conceded to part of the charges against him, as will be addressed IY”H in Hilchos Toein v’Nitan.

Naarah Besulah 2:14

The three payments made for seduction and the four payments made for rape are given to the girl’s father. This is because all the income generated by a minor belongs to her father. If her father is no longer alive, then payment is made to her.
