1,964. No Fine in Capital Cases

The law exempting one from a fine applies to every offense that is subject to execution by the court. In all such cases, there is no financial obligation.

Naarah Besulah 1:15

If the girl who was raped or seduced subsequently dies,* the offender is not liable for the fine. This is because Deuteronomy 22:29 tells us he “must pay to the girl’s father,” which excludes one who is deceased. The offender is only exempt if the girl dies before the case was brought to the court.

*The implication is not that she died as a result of the incident, merely that she later died of whatever cause.
