1,959. When the Oneis May Not Marry His Victim
Naarah Besulah 1:4
The girl who chooses to marry her rapist is not given a kesubah. This is because the Sages created the kesubah to keep husbands from treating divorce lightly. This man can’t divorce her so the matter is moot.
Naarah Besulah 1:5
If the girl is prohibited to the rapist, even if she’s prohibited by a positive commandment or as a secondary relation (i.e., less severe forms of prohibition), then he may not marry her. Similarly, if she commits adultery after he marries her, then he must divorce her. When the Torah says that he must take her as his wife, it requires that she be able to be his wife (which such women are not).
