1,933. Yibum with a Sotah
Yibum v’Chalitzah 6:18
Continuing from the previous halacha, if Shimon made maamar with his yevama, Reuven’s widow, but he died before consummating the relationship, Levi should perform chalitzah with Shimon’s other widow, to the exclusion of yibum. This is because maamar doesn’t finalize the relationship with a yevama, as has been discussed.
Yibum v’Chalitzah 6:19
If a woman willfully commits adultery while married and there are witnesses, her husband must divorce her. If he died before doing so and she fell to his brother, she is not obligated in chalitzah or yibum, nor are her husband’s other widows, the same as if she were forbidden as a prohibited relation. This is because "impurity" is mentioned both regarding prohibited relations and regarding an adulterous wife (“She was made impure” – Numbers 5:13). However, if the husband of a sotah dies before she drinks the water, or if an accused woman must be divorced instead of drinking the waters, she should perform chalitzah to the exclusion of yibum. If the deceased had another wife, that woman may perform chalitzah or yibum.
