1,921. A Woman with Congenital Deafness and a Minor
Yibum v’Chalitzah 5:24
If the deceased brother was married to a woman with congenital deafness and a minor, yibum with one does not absolve the other of her levirate obligation. Rather, the minor should be directed to dissolve her relationship through refusal (miun) and the deceased’s brother should marry the woman with congenital deafness. If he wants to divorce her, he may write a get for her after yibum, after which she is able to marry someone else.

If the deceased brother was married to a woman with all faculties and a woman with congenital deafness, yibum or chalitzah with the former absolves the latter of her levirate obligation. However, performing yibum with the woman who has congenital deafness does not absolve the woman with all faculties because the betrothal of a woman with congenital deafness is a rabbinic enactment. The same applies if the deceased brother was married to an adult and to a minor: yibum or chalitzah with the adult absolves the minor of her levirate obligation while relations with the minor do not absolve the adult.
