1,905. A Yevama Raised Alongside Her Yavams

Yibum v’Chalitzah 4:27

If the yevama violates the law and marries someone else, the yavam must still perform a valid chalitzah with her. She is permitted to remain with her new husband and they are not made to separate.

Yibum v’Chalitzah 4:28

If a yevama grew up with her late husband’s brothers, she is permitted to perform yibum; we are not concerned that she may have performed chalitzah with one of them in private, thereby prohibiting her to all of the brothers. However, if we see that she removed the shoe from one of the brothers, then she may no longer perform yibum out of concern that she might have intended to perform chalitzah. Nevertheless, a valid chalitzah is necessary in order to permit her to marry someone else.
