1,876. A Yevama Who Refuses

Yibum v’Chalitzah 2:9

If the eldest brother is overseas, the younger brother may not delay, saying that the responsibility is his older brother’s. Rather, the brother who is present is told to perform either yibum or chalitzah.

If a yevama who is fit to perform yibum refuses, the rules are the same as those for a woman who refuses intimacy to her husband. The man is compelled to perform chalitzah with her and she forfeits the value of her kesubah. If the deceased had many wives, the one who is asked by a surviving brother to perform yibum and refuses is considered to have rebelled. The yavam should perform chalitzah with her and she forfeits the value of her kesubah. Other wives, who were not asked to perform yibum, receive the value of their kesubahs as widows generally do.
