1,870. Chalitzah with a Pregnant Yevama

Let’s say that a man performs chalitzah with his brother’s widow and she is subsequently found to be pregnant. If she gives birth and the baby is viable, then it’s as if she never performed chalitzah and she may marry a kohein and her husband’s brother may marry her close relatives. If she miscarries or the baby doesn’t live for 30 days, then this brother or another brother should perform chalitzah again. This is because chalitzah performed with a pregnant woman is not chalitzah at all, and intimacy with a pregnant woman cannot be considered yibum.

Pursuant to the previous halacha, if a man marries or performs chalitzah with a pregnant yevama, any other wives of the deceased may not remarry until she gives birth. This is because the child of the deceased doesn’t remove the levirate bond until it’s actually born.
