1,838. A Woman and Two Men Who All Disagree

Let’s say that there’s no presumption that a woman was married. One witness reports that she was married and divorced, while another says that she wasn’t divorced. Since they both agree that she was married but only one says that she was divorced, she may not marry. This is because one witness carries no weight against two witnesses. If she did remarry, the couple is made to separate.

Let’s say that a woman and two men arrive from overseas. Each of the men claims that the woman is his wife and the other man is his servant, while the woman says that both of the men are her servants. In such a case, the woman is free to marry. Even though we have two witnesses testifying that she’s already married, since each of them testified about himself, their testimonies are inadmissible.
