1,789. A Get That Depends on Some Action
Hilchos Geirushin 9:3
If a woman put her get on the side of the public domain and it was stolen or lost after 30 days, divorce is effected. This is because the get still existed on the day it went into effect and it was put in a designated place that was not itself the public domain; the sides of a public domain are not the same as the actual public domain.
Hilchos Geirushin 9:4
If a man makes a divorce conditional on his wife performing some action, the same rules apply as those when a get takes effect after a certain time. For example, if a man tells his wife, “This is your get but divorce is not effected until you give me 200 zuz,” the divorce takes effect when she gives him the money. There is no need for him to restate the condition (i.e., if yes, then X; if no, then Y) nor for her to meet any other conditions, as has been explained. This is because he hasn’t divorced her conditionally; in fact, he hasn’t divorced her at all yet! Rather, he made the divorce dependent on some action, only after which will divorce be effected.
