1,785. Conditions With a Time Frame

If a man stipulates that his wife must do a certain thing but he doesn’t designate a time frame, it’s considered as if he stipulated this condition for one day. For example, if he said, “This is your get on the condition that you do some work for me,” “that you serve my father” or “that you nurse my son,” then if she does some work for him or serves his father for one day, or if she nurses his son for one day during the time when a child nurses, which is the first 24 months, then divorce is effected. If the son or the father dies before she can fulfill the condition, then divorce is not effected.

If a man specifies that a get is conditional on the woman nursing his son or serving his father for two years, then she must do so for the designated period. If the son or the father dies during this time, or if the father refuses her service, then divorce is not effected because the condition wasn’t met. The same is true in all similar cases.
