1,781. Making Eternal Conditions
Hilchos Geirushin 8:11
If a man divorces his wife on the condition that she not go to her father’s house for 30 days, then divorce is effected; that she never go to her father's house, then divorce is not effected. This is because the marital bond hasn’t been severed. If he divorces her on the condition that she never eat meat or never drink wine, then divorce is not effected because the marital bond hasn’t been severed; if the restriction is for 30 days, then divorce is effected.
Hilchos Geirushin 8:12
If a man divorces his wife on the condition that she never marry person X, divorce is not effected. This is like telling her that she can never drink wine or go to her father’s house for the rest of her life. If he stipulates that she may not marry person X for 50 years, then divorce is effected and she may not marry that person for the designated period. If does she marry that person, then the divorce is retroactively voided. If she has extramarital relations with that man, the offspring are legitimate and the divorce remains in effect because the husband only stipulated regarding marriage.
