1,779. Voiding an Invalidating Condition

Hilchos Geirushin 8:7

If a man tells his wife that she may marry any man other than Reuven and Shimon, after which he says that she may marry Reuven or Shimon, then the divorce is valid because he voided the condition, permitting her to marry the men in his condition.

Hilchos Geirushin 8:8

If he only permits her to marry Reuven, then the divorce is invalid because he didn’t void the condition regarding Shimon. If he tells her that she may marry Shimon, or “even Shimon,” then the divorce is in doubt because maybe he only permitted her to Shimon but not to Reuven. The divorce is not invalidated when he says “even Shimon” because he means “everyone, even Shimon,” which may also include Reuven. This is possible since Shimon was named after Reuven in the condition.
