1,774. How an Agent is Appointed

If the second agent gets sick or is otherwise prevented from fulfilling his mission due to circumstances beyond his control, he appoints yet another agent in front of the court. Even 100 agents can be appointed this way. The last agent identifies himself as an agent of the court and gives the woman her get. This is so even if the original agent died. Replacement agents must be assigned by the court because the first agent must state that the get was written and signed in his presence. However, if the signatures on the get were validated, even though one agent gives the get to another in private, then even if 100 agents are assigned this way, the get is valid when it reaches the woman. An agent may appoint a replacement if he gets sick or is impeded by circumstances beyond his control even though the husband did not specify this in his instructions.

When a person appoints an agent, the agent doesn’t have to be present in court. One may tell the court that a certain person is his agent even in that person’s absence. Similarly, one agent can appoint another even in that person’s absence. This continues to be the case even for 100 agents.
