1,719. A Man Who Has Two Wives With the Same Name

Continuing the idea that a get must be written for a particular man and a particular woman, let’s say that a man had two wives with the same name and he wrote a get intending to divorce the older one but he changed his mind and used the get to divorce the younger one. In such a case, divorce is not effected. While the get was written for this man, it wasn’t written for this woman.

Hilchos Geirushin 3:4

Let’s say that the man in the above scenario told the scribe to write the get and he would use it to divorce whichever wife he chooses. If the scribe writes the get based on that understanding and the man then uses it to divorce one of his wives, the validity of the divorce is in doubt. If a get was written without the appropriate intentions, it is invalid even if the scribe rewrites the letters with the proper intentions.
