1,677. A Woman Who Dissolves a Marriage Through Mi’un
Hilchos Ishus 24:5
A woman who unilaterally dissolves a marriage through refusal (mi’un) is not paid the value of her kesubah but she is paid the additional amount. In such cases, the husband is not required to repay her for the benefit derived from her property. If she borrowed money for her own maintenance while they were married and she later dissolved the marriage through refusal, the husband is not obligated to repay the debt.
Hilchos Ishus 24:6
If a woman commits adultery, she is not paid the value of her kesubah – not the baseline amount, not the additional sum, and not any of the kesubah’s conditions. This is because it is her own actions that caused her to become prohibited to her husband.
