443. Grape Nuts: The prohibition against drinking wine of the second tithe outside Jerusalem
…your wine… (Deuteronomy 12:17)
If you grow grapes, you might make wine from them. The wine made from grapes of the first, second, fourth and fifth years in a Sabbatical cycle were subject to the laws of maaser sheini, the second tithe, just like grain. It, too, was not to be consumed outside Jerusalem.
This mitzvah applies at a time when the maaser sheini is in effect. In the Mishna, it is the subject of tractate Maaser Sheini. It is discussed in the Talmud in tractate Makkos (17a) and in Kerisos (5a). It is codified in the Mishneh Torah in the second chapter of Hilchos Maaser Sheini. This mitzvah is #142 of the 365 negative mitzvos in the Rambam’s Sefer HaMitzvos.
