1,658. Why a Husband May Benefit From His Wife's Property

If a husband sells the benefits from real estate to which his wife retains ownership, his actions are meaningless (and the sale is ineffective). This is because the Sages only granted a man the proceeds of his wife’s property in order to make him more generous with the household funds. Therefore, if he sells his rights to these benefits and invests the money he receives in a business venture, he has that option.

If a woman brings iron sheep property into the marriage, her husband may use it in business ventures. Regarding melug property, the same rule applies whether she brought it into the marriage or subsequently inherited it or received it as a gift: it should be sold and the proceeds used to purchase real estate, from which her husband may use the profits.
