1,650. Inheriting a Prohibited Wife

Hilchos Ishus 22:4

If a man marries a woman who is prohibited to him and she dies, he inherits her if the marriage was effective. Similarly, if a man marries a minor, he inherits her if she predeceases him even though the marriage is not completely effective. Conversely, if a man with all his faculties marries a congenitally deaf woman, he does not inherit her when she dies. If a congenitally deaf man marries a woman with full faculties and she dies, he inherits her. This is because she is able to understand and willingly married him, which gives him a right to inherit her.

Hilchos Ishus 22:5

If a minor was betrothed with her father’s consent but married without his consent, regardless of whether or not this happened in his presence, the father can object as was discussed in halacha 3:13. If the girl dies, the husband does not inherit her even if the father remains silent, unless the father consents to the marriage.
