1,615. If the Yevama's Brother-in-Law Doesn't Follow Through
Hilchos Ishus 18:16
Let’s say that a widow filed a claim against her brother-in-law to either perform yibum or undergo chalitzah and he appeared in court but then ran away or got sick (and was unable to follow through), or if the brother-in-law lived abroad. In such cases, the woman is entitled to draw her maintenance from the brother-in-law’s property without having to take an oath.
Hilchos Ishus 18:17
If the brother-in-law for whom the widow is waiting is a minor, the woman is not entitled to draw maintenance from him until he reaches the age of majority and legally resembles other brothers-in-law.
