1,541. Conditions About Marital Rights and Responsibilities
Hilchos Ishus 12:6
If the husband makes a condition that he is not responsible for one of his obligations, or if the wife makes a condition that he not receive one of the benefits, such a condition is binding except for three things about which no conditions may be made, namely the wife’s conjugal rights, the baseline amount of the kesubah and the husband’s right to inherit his wife. A condition made about any of these three things is immaterial.
Hilchos Ishus 12:7
Accordingly, if the husband stipulated that he is not required to give the wife her conjugal rights, the condition is meaningless because he made a condition not about financial matters that goes against what is written in the Torah.
