1,480. More Cases of Marrying a Woman Using Dates as Kiddushin

In the previous halacha, we discussed a man who asks a woman to be consecrated to him by giving her several individual dates one after the other. Let’s say that he says to her, “Be consecrated to me with this date, and this one and this one” (i.e., in a single statement, handing them to her in rapid succession). If the dates are collectively worth a prutah, marriage is effected; if not, the situation is in doubt. Let’s say that the woman eats each of the dates as he gives them to her. If the last date is worth a prutah, then marriage is effected; if not, then the situation is in doubt. This is because the dates she ate are considered like a loan and marriage cannot be effected through a loan. Therefore, whether or not marriage is effected depends on the last date.

If the man says “Be consecrated to me through these dates,” then marriage is effected if all the dates are collectively worth a prutah. Unlike the case in halacha 5:27, this is so even if she eats the dates as he gives them to her. In this case, marriage is effected because she is eating her own property.
