Let’s say that a man jointly owns merchandise with a partner and he divides this merchandise without his partner’s knowledge, using his share to consecrate a woman. In such a case, marriage is not effected because the court needs to assess the partners’ assets. A partner may not unilaterally just take what he wants and leave the rest.
Hilchos Ishus 5:10
Let’s say that a man stole something from a woman by force or by stealth, or otherwise took it from her without her consent. He later uses it to consecrate her. If they were already discussing marriage and she accepted the object without comment, marriage is effected. If marriage was not already on the table, marriage is not effected even if she said nothing when he gave her the object. However, if she explicitly agrees, then marriage is effected.
