1,457. When the Woman Tells the Man to Put the Kiddushin Somewhere
Hilchos Ishus 4:3
If a man asked a woman to be consecrated to him through the transferal of a dinar, and she took the coin and, in his presence, threw it in the ocean, or into a fire, or into anything else that would destroy it, then marriage is not effected. If she told him to give the coin to her father, to the man’s own father or to another person, marriage is not effected. If she told him to give it to a third party who would accept it for her, then marriage is effected.
Hilchos Ishus 4:4
If the woman told the man to place the kiddushin on a rock, then marriage is not effected. If she owns the rock, then marriage is effected. If the two of them jointly own the rock, then there is a doubt as to whether or not marriage is effected. If the man asked the woman to be consecrated to him through the transferal of a loaf of bread and she told him to give it to a needy person, then marriage is not effected. This is so even if she financially supports that person. If she told the man to give the kiddushin to a dog, marriage is not effected. If she owns the dog, then marriage is effected. If the dog was chasing her and she told the man to give it to the dog, then there is a doubt as to whether or not marriage is effected.
