953. A Courtyard That Leads to Two Alleys

When one resident of an alley owns a storeroom full of wine, oil, etc., he may grant a portion to the other residents of the alley and make the shittuf on their behalf. Such a shittuf is valid even though he did not separate or designate the portion he granted them, leaving it among all the contents of his storeroom.

If a courtyard has two entrances, leading to two different alleys, and the residents make a shittuf with just one alley, they may not carry to or from the other alley. Therefore, if one grants a portion of food to all the residents of the alley and makes a shittuf on their behalf, he must inform the residents of the courtyard. They must have the intention to participate in the shittuf because we cannot take for granted that including them is for their benefit; perhaps they want to make a shittuf with the other alley, to the exclusion of this one.
