R. Uzziel on Whether "Al Menat" Means a Condition (17 Iyar)
שו"ת משפטי עוזיאל חושן משפט ד:ל"ד 17 Iyar 5692 (1932)
A condition of sale is different from a parameter - if I sell you all the raincoats in my closet other than the blue one, that's parameter. If I sell them on the condition that you win the game on Sunday, that's a condition. The words al menat, often translated as "on condition that," seem to function in both ways, sometimes as a condition, sometimes a parameter. Which is true when? R. Uzziel clarified his view, in response to receiving R. Yitzchok Hutner's sefer, Torat HaNazir.
