1,243. Distributing One's Wealth
193:6 The patient should not give away his property, not even to charity, as this would disinherit his heirs. One who does this displeases G-d, even if the patient's heirs don't treat him properly. However, if he leaves a sufficient amount to his heirs, then it is permitted. The pious will not sign as witness nor advise on a will that attempts to bypass the heirs' inheritance rights, even to divert money from a son who doesn't behave appropriately to his wiser brother who does. Perhaps the less-deserving son will have good and proper descendants. Some authorities prohibit even to give a little to one son and a lot to another. One should heed this position.
193:7 If the patient has young children, or both young and grown children, or if his wife is expecting, he must appoint a guardian to administer funds on behalf of the minors until they grow up.
