1,207. Benefit from Another's Property Without Permission
182:13 It is prohibited to benefit from another person's property without his knowledge. This is true even if one knows that the owner would be happy to do so because they're good friends. Therefore, if one enters the orchard or garden of a friend, he is not allowed to pick fruit without the owner's knowledge even if they're very close and he would surely permit it. This is because at this moment, the owner is unaware so the visitor would be deriving benefit impermissibly. The public should be instructed in this since many people err in this matter.
182:14 In any event, the member of a household is permitted to give bread to a needy person or to the son of a good friend of the master of the house without his knowledge. This is because homeowners are accustomed to doing such things, so it isn't considered "without the owner's knowledge." For the same reason, one may accept something small as charity from a woman without the knowledge of her husband; it's the accepted practice for wives to do this and husbands know that. Similarly, if one is frequently in an orchard and eats the fruit with the knowledge of the owner, he is also permitted to do so when the owner is not aware. This same is true in any similar situation.
