3,476. Who Is Considered a Merchant?

Let’s say that someone buys produce from a non-Jew in land that was occupied by Jews who ascended from Babylonia. If the non-Jew was a merchant who buys produce from Jews, it is considered demai. Therefore, when most of Israel is controlled by Jews, when someone buys produce from a non-Jewish merchant, he takes tithes for demai just like one does when buying produce from an unlearned Jew.

Hilchos Maaser 13:9

The definition of a merchant is someone who brings produce to market two or three times. If he only brings it once, he is not considered a merchant. This is true even if he brings three loads at one time, or if he, his son and his servant each bring a load.
