3,450. Torah Scholars Have a Presumption Regarding Tithes

Hilchos Maaser 10:2

A Torah scholar is automatically considered trustworthy regarding tithes, so there’s no need to check him. His children, servants, wife and other members of his household are also considered trustworthy regarding tithes. If a Torah scholar dies and leaves produce behind, we assume that it was tithed even if it was harvested on the day he died.

Hilchos Maaser 10:3

If the daughter or the ex-wife or widow of an unlearned person marries a learned person, or if the servant of an unlearned person is sold to a learned person, they must accept the aforementioned rules regarding tithes. If the daughter or ex-wife/widow of a learned person marries an unlearned person, or if the servant of a learned person is sold to an unlearned person, we assume that they continue to act in the manner of learned people until their actions suggest otherwise. If the son or servant of a learned person regularly visits an unlearned person, he must overtly accept the rules regarding tithes. If the son or servant of an unlearned person regularly visits a learned person, he is considered like a learned person for the duration of his visit. Once he leaves, he is again considered an unlearned person.
