3,407. Courtyards That Are Planted

A courtyard that has been plowed is the same as a garden and one may snack in it; this is the case so long as the greater part of the courtyard has been plowed. If he planted in the greater part of it, he may not snack on untithed produce in the courtyard; this is also the case if he planted trees in it. If he planted trees in the courtyard in order to beautify it, since the field has been plowed, he may snack from the untithed fruit of those trees.

If a fig tree grows in a courtyard, one may eat individual figs from it without obligating them in tithes, but once he collects them, they must be tithed. This is the case when one is standing on the ground; if one climbs to the top of the tree, he may fill his embrace with figs and eat them there. This is because the open area of a courtyard doesn’t obligate produce in tithes.
